Montgomery, AL – State Representative Alvin Holmes is refuting a report that says he was driving under the influence of alcohol when he was pulled over last week near Montgomery.
A Montgomery County sheriff's deputy stopped Holmes just before midnight on Wednesday after saying Holmes was driving erratically on Interstate 65. The deputy also says Holmes' speech was slurred and his breath smelled of alcohol. But Holmes says that is not what happened. He says his pickup truck began to overheat and he had pulled over to look for a flashlight.
The deputy did not arrest Holmes because state law prevents lawmakers from being arrested for most crimes during a legislative session. The exceptions are felonies, treason or breach of peace.
Instead, the deputy called one of his supervisors, who drove Holmes back to his house.
