Court Upholds Gaming Decision

Mobile, AL – The Alabama Court of Civil Appeals is supporting the seizure of 127 gaming machines from two adult arcades in Mobile County. Kevin Sharp Enterprises owns the machines. The company argued it did not have fair warning that the machines might be illegal under Alabama law. But the appeals court rejected that argument in an unanimous decision Friday. The appeals court upheld a lower court order that determined the gaming machines must be forfeited to the state. Kevin Sharp Enterprises also must turn over more than 11-thousand dollars in cash. The Mobile County district attorney's office seized the games and cash during raids in 2001.
