Birmingham, AL – A Jefferson County jury will return Wednesday for a third day of deliberations as they try and decide the fate of convicted police killer Kerry Spencer. A court official says 10 of the 12 jurors would need to agree to recommend death for the 25-year-old. Seven would be needed to recommend life without parole. The judge then has the authority to either accept or reject the jury's recommendation. The 12-member jury told the Circuit Judge Tuesday they were deadlocked on Spencer's punishment. But he gave them new instructions and ordered them to continue talking. Spencer was convicted Sunday on three counts of capital murder and one charge of attempted murder for the 2004 shooting deaths of three Birmingham police officers.
