Supreme Court Orders New Trials In 2 Capital Cases

Montgomery, AL – The Alabama Supreme Court has ordered new trials for two men on death row.

The court on Thursday overturned the conviction of Kenneth Eugene Billups in the shooting death of Stevon Lockett during a robbery in Birmingham on Dec. 13, 2003. The court says Billups should receive a new trial because the judge erred when he let jurors hear evidence about Billups' conviction in a separate capital murder case.

The justices also ordered a new trial for Jimmy Lamar Killingsworth. He was convicted of killing a man in a drive-by shooting in Bibb County on Christmas Eve 2004. The court says a potential juror should have been eliminated from the jury pool after saying she couldn't be impartial about the case.
