Montgomery, AL – The Alabama Supreme Court has withdrawn a ruling it issued last year blocking electronic bingo machines in Ashville.
The court issued a new ruling Friday that said the matter never should have been in court because there was no proper controversy. The ruling corresponds with other decisions from the court that it doesn't answer hypothetical questions.
The Ashville City Council approved an ordinance in 2008 to allow electronic bingo games, and it got a court ruling that the machines were legal.
The district attorney, sheriff and governor appealed to the Supreme Court, and the justices originally ruled the games didn't qualify as bingo. The new ruling says the case didn't belong in court because no legal action had been taken against the machines.
