The Southern Poverty Law Center is taking its legal challenge of the Alabama Accountability Act to a federal appeals court.
The Montgomery-based group has asked the 11th U.S. Circuit Court of Appeals to review a federal judge's decision rejecting the law center's challenge of the state law.
The law provides tax breaks for parents who move their children from failing public schools to non-failing public schools or private schools. The Southern Poverty Law Center challenged the law on behalf of eight students in failing public schools who say they have no non-failing public schools or private schools nearby. U.S. District Judge Keith Watkins rejected the challenge in April.
A separate suit in state court recently resulted in a judge ruling against the law. State officials are appealing that ruling.
