Justices Step Down from Ballot Case

Montgomery, AL – State Supreme Court justices Jean Brown and Lyn Stuart have stepped down from hearing an appeal involving a Mobile radio talk show host. Kelly McGinley has filed suit to stay on the Republican primary ballot for a seat on the state board of education. Attorneys for both sides say the recusals won't change anything about the case. The state Supreme Court is considering the Republican Party's appeal. Party officials say they should be able to disqualify McGinley from the Republican ballot because of previous criticisms and questionable party loyalty.
