Judge Denies Prosecutors Access to Some Rudolph Files

Birmingham, AL – Federal prosecutors have lost a bid to reduce the amount of secrecy in the death penalty case against Eric Rudolph. Federal Judge Lynwood Smith ruled Thursday against their request to see documents filed under seal by his lawyers. Rudolph was arrested in North Carolina in 2003 after being a fugitive for five years. He's charged with setting off a bomb that killed a Birmingham police officer outside an abortion clinic in 1998. He remains in the Jefferson County Jail without bond. His trial has been delayed until next spring. Rudolph is also charged with three bombings in Atlanta.
