Birmingham, AL – A federal prosecutor says the government will not try to get more prison time for a former HealthSouth executive who was ordered to undergo a second sentencing. U.S. Attorney Alice Martin made the comment after last week's decision by the 11th U.S. Circuit Court of Appeals. That ruling said a federal judge made a mistake when computing the amount of money that former assistant controller Emery Harris cost HealthSouth investors by his role in the two-point-seven billion dollar fraud. Harris has already served his five-month sentence for his part in the scam, and he's now serving five more months of house arrest. Federal Judge Inge Johnson sentenced Harris in December after ruling that he cost shareholders only a fraction of the money suggeted by prosecutors.
