Judge Won't Remove Death Penalty Possibility

Luverne, AL – Circuit Judge Ed McFerrin will not rule out the death sentence for Westley Devon Harris. He was convicted of capital murder this week in the shooting deaths of six members of his girlfriend's family. It happened in rural Crenshaw County. Harris' defense asked the judge to take the death penalty off the table because of testimony that Harris has an I.Q. of 70. But the judge declined. There was conflicting testimony about Harris' I.Q. Earlier testimony put it at 85. The jury is to recommend whether Harris should be sentenced to death or life without parole. Judge McFerrin will make the final decision.
