A federal appeals court in Atlanta has upheld a lower court ruling that VictoryLand casino and dog track may owe its former employees millions.
The 11th U.S. Circuit Court of Appeals upheld part of a lower court ruling that said VictoryLand did not give proper notice to its employees under the federal Worker Adjustment and Retraining Act before closing twice in 2010 to prevent raids by Gov. Bob Riley's gambling task force. The law requires a 60-day notice before a mass layoff or closure. The appeals court told the lower court to take another look at whether a layoff in January 2010 also required notice to employees.
An attorney for the former workers told the Montgomery Advertiser the judgment could be worth $3 million to $5 million in pay.
