The Alabama Supreme Court has blocked a lawsuit challenging a new law that provides tax credits for attending private schools.
Members of the Alabama Education Association had filed the suit against several legislators. AEA contended the Legislature violated its own rules and the state open meetings law when it passed the Alabama Accountability Act in February. The Supreme Court ruled Friday that Alabama's Constitution doesn't require the Legislature to meet in public, and the open meetings act must yield to the Constitution. The court also said it's not the function of the courts to require the Legislature to follow its own rules.
Two other lawsuits are pending against the Accountability Act. The act provides tax credits for parents who move their children from failing public schools to participating private schools.
