Montgomery, AL – A federal judge has dismissed a lawsuit that accused Alabama officials of violating a law that protects absentee voters overseas, including those serving in the military.
With the state now in compliance, U.S. District Judge Keith Watson ordered that the U.S. Justice Department's lawsuit against Alabama be dismissed.
The Justice Department had filed the lawsuit last year accusing the state of failing to file reports on overseas absentee ballots as required by a 2002 federal law. The judge dismissed the lawsuit last week, a day after the Justice Department filed a motion saying it had received the information it was seeking.
The lawsuit sought to compel Alabama officials to file the required reports on overseas absentee ballots in the Nov. 4, 2008 election and future federal general elections.
