Fuller Says New Judge Should Hear Scrushy Recusal Bid

Montgomery, AL – A federal judge in Montgomery has asked that another judge be appointed to decide if he should handle requests for new trials filed by former Alabama Gov. Don Siegelman and former HealthSouth CEO Richard Scrushy.

U.S. District Judge Mark Fuller on Friday asked the chief judge for the 11th U.S. Court of Appeals to determine if Fuller should recuse himself because of a meeting he held with U.S. Marshals outside the presence of defense attorneys.

Fuller's request comes almost a year after Scrushy and Siegelman filed motions seeking a new trial. Scrushy last month asked Fuller for a prompt ruling on the recusal issue. Siegelman and Scrushy were convicted in 2006 of bribery and other charges.
