Birmingham, AL – Former State Rep. Sue Schmitz has filed a motion seeking a new trial following her conviction on seven fraud charges last month.
Schmitz' motion includes four reasons why she believes a new trial is warranted, including claims that the jury's verdict was contrary to the weight of the evidence presented and the court made errors in not overruling objections by prosecutors.
The Toney Democrat was accused of taking more than $177,000 in salary from the federally funded Community Intensive Training for Youth program and doing little or no work over three years.
Schmitz remains on bond until her sentencing, which U.S. District Judge David Proctor said would be in about 90 days.
