Judge Asked to Exclude Evidence

Birmingham, AL – Even though the case against former HealthSouth C-E-O- Richard Scrushy has been delayed a week, federal Judge Karon Bowdre on Monday heard a request to exclude some of the prosecution's evidence. Defense attorneys asked her to exclude a secretly recorded conversation with Scrush. The prosecution says the recordings show Scrushy was involved in a conspiracy to overstate the company's earnings. But Scrushy's defense says the recordings are flawed and can't be used. Scrushy has pleaded innocent to dozens of charges that he led a conspiracy to overstate HealthSouth earnings by more than two-point-six billion dollars.
