Judge Upholds Mountainboro Annexation

Boaz, AL – Etowah Circuit Judge David A. Kimberley needed a review of one of seven challenged ballots to decide that Mountainboro's 2007 referendum calling for its annexation by Boaz won by a single vote.

Boaz City Attorney Danny Smith said Tuesday the annexation cannot proceed for 42 days to allow ample opportunity for an appeal to be filed.

Kimberley wrote that one of the challenged "no" votes "appears clearer cut than the others" to be invalid.

The rejection of the invalid vote resulted in an 80-79 vote for annexation.
