Montgomery, AL – Pretrial motions in the government corruption cases of former Governor Don Siegelman and former HealthSouth Chairman Richard Scrushy continued in Montgomery federal court Tuesday. Siegelman's attorneys asked US District Judge Mark Fuller to dismiss most of the charges because of faulty wording in the indictment. They say the indictment accuses him of failing to provide ``honest and faithful services'' but it should have said only ``honest services''. Because of that defense attorneys say Siegelman is being prosecuted on a charge that doesn't exist. Prosectuors say the argument is a red herring. No word on when a ruling might come. Meanwhile before US Magistrate Charles Coody, attorneys for Scrushy tried to get their case dismissed by accusing prosecutors of misconduct. They say prosecutors misled them into providing information about their strategy for the case. Prosecutors deny the accusation, and say Scrushy wouldn't have been indicted if he had cooperated during the investigation.
