Montgomery, AL – Federal probation officers have asked that former HealthSouth C-E-O Richard Scrushy be confined to his home and that a monitoring device be used to keep track of his movements.
A filing Thursday in federal court in Montgomery accuses Scrushy of violating the terms of his release on bond last year after he and former Alabama Governor Don Siegelman were convicted on bribery and conspiracy charges. Scrushy and Siegelman have remained free awaiting sentencing.
In the filing, federal probation officer Tamara Martin says Scrushy violated the terms of his release while on a family-trip to Orlando, Florida earlier this month.
U-S Magistrate Judge Charles Coody has scheduled a hearing for 10 a-m April nine to decide if Scrushy should be confined to his home in Birmingham's southern suburbs.
Chief prosecutor Louis Franklin says prosecutors have not decided what position to take at the hearing.
Scrushy's attorney Art Leach says his client did not violate terms of his release. He says Scrushy went to Florida to take his children to Disney World and to visit friends and family members.
