Montgomery, AL – Federal prosecutors are appealing a judge's decision to allow former HealthSouth CEO Richard Scrushy to remain free on bond until his sentencing in a federal bribery case.
Prosecutors filed the appeal in federal court in Montgomery Thursday. The appeal says that U-S Magistrate Judge Charles Coody made an error when he allowed Scrushy to remain free.
Prosecutors had asked Coody to revoke Scrushy's bond because he took a trip on his 92-foot yacht from West Palm Beach, Florida to Miami. The trip came while Scrushy was supposed to be on a court-approved spring break vacation trip to Disney World.
Coody made his ruling following a day-long hearing Monday.
The motion appealing Coody's decision was signed by chief prosecutor Louis Franklin. It says there is not assurance that Scrushy will not try to flee before his sentencing.
