Montgomery, AL – A Baldwin County mother convicted of capital murder in the death of new newborn son is going to get a new trial.
The Alabama Supreme Court ruled 8-0 Friday there were problems with jury selection in the trial of Marsha Gossett Colby.
Defense attorney John Beck of Fairhope said the decision was welcome news for his client, who is in Tutwiler Prison in Wetumpka. She maintains the child was stillborn, not murdered, he said.
Colby, who is 45, was convicted of capital murder in 2007 and sentenced to life in prison without parole.
She claimed her child was stillborn and was buried in the backyard of a camper where she lived with her other children and common-law husband. Prosecutors argued that the child was born alive and then killed.
