Montgomery, AL – Former HealthSouth CEO Richard Scrushy is asking from a prompt ruling on his request that a judge step down from considering his motion for a new trial in a government corruption case.
In a motion filed this week, Scrushy complains that U.S. District Judge Mark Fuller hasn't ruled on a June motion asking him to recuse himself from hearing Scrushy's motion seeking a new trial.
The motion asks Fuller to rule or let another judge decide the issue.
Scrushy and former Alabama Gov. Don Siegelman have both filed motions seeking new trials. Siegelman and Scrushy were convicted in 2006 of bribery and other charges.
Scrushy asked Fuller to recuse himself because of a meeting he held outside the presence of defense attorneys with U.S. Marshals.
