Judge Wants FBI Agent To Testify About Wiretaps

Montgomery, AL – A federal judge is reopening a hearing on whether to suppress FBI wiretaps that are at the heart of Alabama's bingo corruption probe.

U.S. Magistrate Judge Wallace Capell Jr. said FBI agent Doug Carr must return to the witness stand Tuesday because government prosecutors did not turn over all e-mails involving the wiretaps when they should have.

Defense attorneys told the judge in a hearing Friday that they got four e-mails from prosecutors days after the original suppression hearing, which ended March 2. Federal prosecutor Peter Ainsworth told the judge a mistake was made and he had no excuses.

Capell said this is not the way a prosecution should be conducted.

Ten people, including two casino owners, face trial June 6 on gambling corruption charges.
